David Wilkins, pro se.

Stephen H. Sachs, Attorney General; J. Mark Moore, III, Assistant Attorney General, for appellee.

Before WILKINSON and WILKINS, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

A review of the record and the district court's opinion accepting the recommendation of the magistrate discloses that this appeal from its order refusing relief under 42 U.S.C. Sec . 1983 is without merit. Because the dispositive issues recently have been decided authoritatively, we dispense with oral argument and affirm the judgment below on the reasoning of the district court. Wilkins v. Lyles, C/A No. N-82-941 (D.Md., Jan. 9, 1986).

AFFIRMED.
